CercaYa is a project of Service Anaslone LLC («the Company»), which operates the site cercaya.com under the trade name CercaYa. By using the site you accept these terms. If you do not agree, do not use the service.
CercaYa is a directory that connects people with local businesses and entrepreneurs in the United States, with initial coverage in Georgia.
When you publish a business you undertake to provide truthful and up-to-date information, to have the right to offer what you advertise, and to answer through the channels you indicated. We may reject, suspend or remove a listing if it breaches these terms, if we receive substantiated complaints or if we detect impersonation. Publishing during the pre-launch phase is free; paid plans are described in Plans.
Paid placements are always identified as «Sponsored» or «Featured sponsored», kept separate from organic results. Paying does not make a business «the best», does not guarantee a position outside its category and area, and does not mean that we will generate sales, customers or visits. You are buying presence, not results.
Not permitted: publishing illegal or misleading content, or third-party content without consent; impersonating another person or business; sending spam; harvesting data at scale; attempting to alter how the site works; or using the directory to harass or discriminate against anyone.
The business retains ownership of its texts, photos and logos, and authorizes us to display them on the site and in the directory's materials while its listing is published. It is responsible for holding the rights to that content.
When the customer authorizes a channel, the conversation takes place outside this site, on WhatsApp, by text message or by call. Those platforms have their own terms and policies, and they do not depend on the Company. If you use WhatsApp, the WhatsApp and Meta conditions also apply.
How data is handled is explained in the Privacy Policy, which forms part of these terms.
CercaYa is a directory, not the provider of the service. We publish business listings and put people in touch with them. We are not a party to the agreement between the customer and the business, we do not charge for that work, and we do not take part in how it is done or what it costs.
Being listed is not a recommendation or an endorsement. The options we show are an automatic selection by category and distance: they are not professional advice, a quality guarantee, or our opinion about that business. A business marked «Sponsored» paid for that space and nothing more: it does not make it the best or the safest.
The service is provided «as is». To the maximum extent permitted by law, CercaYa is not responsible for:
Each party answers for its own side. If you hired work and something went wrong, the claim is against the business, not against CercaYa. If you are the business, a claim for non-payment is against the customer.
Licenses and insurance are yours to check. We do not verify licenses, permits, insurance or background checks for businesses unless a profile expressly says so. Before hiring work in your home, ask for insurance and a license: that is your responsibility, as with any other directory.
Reviews. They are not bought, not deleted for being negative, and not rewarded. A business may not offer discounts in exchange for a review, or use contract clauses that forbid customers from reviewing: U.S. federal law prohibits it (Consumer Review Fairness Act, 15 U.S.C. § 45b).
Maximum cap. To the maximum extent permitted by law, CercaYa's total liability to you will not exceed the greater of: what you paid us in the previous 12 months, or 100 dollars. We are not liable for indirect damages, lost profits, lost business or reputational harm.
Indemnity. If someone makes a claim against CercaYa because of something you did — content you published, a breach of these terms, or a service you provided — you take on that defense and its costs.
And one thing that cannot be taken away. Nothing in this section limits rights the law gives you as a consumer that cannot be waived. If part of this text does not apply in your state, that part falls away and the rest stands.
CercaYa is a trade name in use by Service Anaslone LLC. As of the date of this version it is NOT a registered trademark. The Company reserves the right to apply for its registration. The names and trademarks of the businesses listed belong to their owners.
We may update these terms; the date above indicates the version in force and significant changes will be announced on the site. They are governed by the laws of the State of Georgia, USA.
